Do I need malpractice insurance?

A lawyer needs to have legal malpractice insurance (also called lawyers professional liability insurance or LPL coverage) OR inform a client that she/he does not have malpractice insurance at the time of the client’s engagement or at ANY time subsequent to the engagement if the lawyer does not maintain such insurance. (See Ohio Rule of Professional Conduct 1.4) This insurance must be in the amounts of at least $100,000 per occurrence and $300,000 in the aggregate. The lawyer also must inform the client if the lawyer’s malpractice insurance is terminated.

If the lawyer does NOT have malpractice insurance, she/he must have the client sign the NOTICE TO CLIENT form found in Rule 1.4. The lawyer must keep a copy of the notice signed by the client for 5 years after termination of representation of the client.

Amendments Effective July 1, 2014

  • THE OHIO RULES OF CRIMINAL PROCEDURE
  • THE OHIO RULES OF JUVENILE PROCEDURE

The Ohio Supreme Court adopted amendments, effective July 1, 2014, to Rules 4, 9, 10, 11, and 43 of the Ohio Rules of Appellate Procedure, Rules 4.3, 4.5, 4.6, 7, 33, 36, 45, 75, and 86 of the Ohio Rules of Civil Procedure, Rules 5, 41, and 59 of the Ohio Rules of Criminal Procedure, and Rules 40 and 47 of the Ohio Rules of Juvenile Procedure.  (Note: Appellate Rule 43, Civil Rule 86, Criminal Rule 59 and Juvenile Rule 47 address Effective Dates.)

Our On-line Application: an Easier Way to Apply for Insurance

OBLIC is pleased to announce an easier way to apply for insurance, either as new business or at renewal – our new E-App.  This on-line application will allow you to complete the entire application process over the internet, including any required supplements, thereby shortening the time between application and policy issuance.

For new business, just click on APPLY NOW.  For renewal business, watch your emails.  An announcement and instructions will be sent to you prior to your renewal.
