Punitive Damages Award Can Be Imposed on Estate of Tortfeasor

In an Opinion written by Chief Justice O’Connor, the Ohio Supreme Court held that where liability has been determined while the tortfeasor was alive, punitive damages are available to the plaintiff after the tortfeasor’s death and may be imposed against the tortfeasor’s estate.  Click here to read Whetstone v Binner.
