This is a continuing series in which we address policy coverage questions that we routinely discuss with you and your colleagues. The answers provided are based on the basic policy form, currently LPLP-1s (effective for all policies new or renewed as of May 1, 2018). I think I may have a conflict of interest in continuing to represent my client, am I covered?

Yes. If you contact us when you have the first inkling that a conflict of interest may exist, we can help guide you through the issue.

Every policy has up to an hour of free ethic’s consultation each policy year. If we cannot help you with the conflict issue, we will pay for an ethics consultation with experienced ethics counsel to provide a formal opinion at no cost to you. (No deductible applies and it does not count as a claim on your policy.) We want to nip these issues before they blossom into serious problems and claims. If you think you may have conflict, please reach out to us.

As you should expect, these Q&A scenarios are based on simple hypotheticals. Coverage determinations for an actual claim are ultimately based on the unique facts, applicable law, and the Terms, Conditions, Limitations, Exclusions, and Endorsements of your policy.
