Hotline Questions: What to Do with Client Files?
Post on February 4th, 2021

What to do with client files is one of the most-asked questions to the Hotline. OBLIC has offered guidance on the importance of record retention in managing client files, sending file closing letters and returning files to clients at the conclusion of representation. See OBLICAlert 5 8 2020, OBLIC Alert 11 1 2019, OBLICAlert 4 30 2019, and Malpractice Alert Fall 2019. We have referenced the Ohio Ethics Guide: Client File Retention from the Ohio Board of Professional Conduct.

The Office of Disciplinary Counsel has just issued a brochure, Managing Client Files & Trust Accounts, with definitive information for the current practitioner, for those winding down a practice. This information is consistent with what OBLIC has been suggesting and gives specific timelines for returning client files.

OBLIC is pleased to share this new information. As always, if you have any questions on this or any other topic, please do not hesitate to contact me.
