OHIO SUPREME COURT UPHOLDS DAMAGE CAPS

In a decision issued December 14, 2016, the Ohio Supreme Court upheld the constitutionality of caps on noneconomic damages in Ohio Revised Code 2315.18(B)(2). The appellant argued that the statute was unconstitutional as applied to minors who are victims of sexual assault. Citing its 2007 decision in Arbino V. Johnson & Johnson, the Court rejected the constitutional challenges to R.C 2315.18. Click here to read more.
